Terms of sale

Product sales made on the Intrade SAS brand Modena Gioielli website www.modenagioielli.com are governed by these General Sales Conditions. 

These general conditions of sale are also governed by the Consumer Code (Legislative Decree No. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Legislative Decree No. 70/2003 and subsequent amendments).

The Customer is required, before submitting his order, to carefully read the following General Conditions of Sale and to read the technical data sheets associated with each product purchased. The forwarding of the purchase order implies full knowledge and express acceptance of the aforementioned general conditions of sale.  

 

These general conditions of sale have as their object the sale of products made online through an e-commerce service on the website www.modenagioielli.it

In the event of changes in the General Conditions of Sale, at the time of a Customer's purchase order, the General Conditions of Sale published on this site at the time the Customer sends the order will apply.

The products are sold directly by the company Intrade SAS (VAT number 01362901009), owner of the Modena Gioielli brand, in the person of the legal representative Mr. Stefano Modena, with registered office in Viale Cortina D'Ampezzo, 251, 0035 Rome, number Chamber of Commerce 484358, PEC address intradesas@pec.it

 

Intrade SAS is engaged in the retail and wholesale of jewelery and also acts as an import / export intermediary for the sale of investment diamonds and precious stones. 

As a guarantee for customers, Intrade SAS is also equipped with a license issued by the Rome Police Headquarters for this activity.

AUTHENTICITY AND GUARANTEE OF JEWELS

 

All jewels have the trademark and the gold title hallmark. All jewels are also accompanied by a certificate of guarantee which certifies their authenticity.  The warranty is valid for 24 months for individuals and 12 months for companies and / or holders of a VAT number. 

Intrade SAS ensures that all jewels are carefully supervised through quality control.  

 

All prices shown are intended for the public including VAT.  

 

The Intrade SAS company guarantees the authenticity of all the products in the catalog and the highest quality of all the materials used in the handcrafted manufacture exclusively made in Italy. It also guarantees the authenticity of the precious stones and the metal used for the manufacture of the jewel, strictly in accordance with the law.  

 

The warranty applies to products that present manufacturing defects or, in any case, an alleged non-conformity, provided that the product itself is used correctly.  

 

The guarantee is subject to these rules:  

  • The warranty is void in case of improper use or tampering with the object.

  • Accidental loss of the stone (s) is excluded from the guarantee.

  • All components of the jewel subject to natural deterioration and wear are not covered by the guarantee, as well as the differences related to the natural and physical characteristics of the materials used (for example, by way of example only, irregularities, color shades of precious stones, chromatic variations of metals). 

  • As for pearl jewelery, Intrade SAS also specifies that pearls are to be understood as organic material subject to premature deterioration. Deterioration (especially if due to the use of perfumes, detergents, sweat or the acidity of the body pH), as well as the differences related to the physical and natural characteristics of the pearl (s) are therefore excluded from the guarantee. 

  • Also excluded from the guarantee are loss and theft, as well as defects due to accidental events, improper use or tampering, alterations due to wear, repairs not carried out by our laboratory, cleaning or maintenance interventions with the use of products not supplied by Intrade SAS, replacement of parts and / or accessories of the jewel not authorized by the Seller. 

  • If the object to be sent for repair is not covered by the guarantee, Intrade SAS undertakes to send the Customer a cost estimate. 

  • The times for repairs under warranty are established by the Seller. The timing may vary according to the type of intervention, however within a maximum limit of 60 days. 

  • The Seller may reserve the right to request one or more exemplary photographs of the item in order to verify whether the damaged product is suitable for repair under warranty.

 

 

OBLIGATIONS OF THE CUSTOMER

 

The Customer is prohibited from entering false and / or invented and / or fictional names in the registration procedure on the Site, ordering online and in further communications. 

Intrade SAS reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.

 

By accepting the aforementioned Conditions of Sale, the Customer agrees to:  

  • Exempt Intrade SAS from any liability due to any errors in the issuance of tax documents due to errors in the data provided by the Customer at the time of placing the order. 

  • Also exonerate the company Intrade SAS from any liability deriving from failure to operate or from problems relating to the e-mail address provided by the Customer for sending the order confirmation and any future communication. 

  • Exempt the company Intrade SAS from any liability deriving from errors or delays in accessing the Website by the Customer when entering their data in the purchase procedure.  

 

The responsibility of the company Intrade SAS is excluded even in case of slowness or impossibility of receiving the order confirmation from the Customer, as well as in any eventual and unforeseeable problem, which cannot be said to be attributable to the company itself.  

 

Furthermore, Intrade SAS is not liable to the Customer in the event of damage caused by the suspension or interruption of the operation of the Site and in the event of damage caused by computer attacks carried out by third parties on the Site.

 

Intrade SAS may not accept orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect, for example in the case of discontinued products. 

In these cases, the company undertakes to inform the Customer by e-mail and / or WhatsApp messaging, communicating that the Contract is not concluded and that the Seller has not carried out the order, specifying the reasons.  

 

If the products presented on the Website are no longer available or on sale after sending the Order, Intrade SAS will promptly communicate and in any case within thirty (30) working days from the day following that in which the order was sent, any unavailability of the Products ordered.  

 

Intrade SAS reserves the right to refuse orders from a customer (including a VAT number) with whom a legal dispute relating to a previous order is in progress. 

This applies equally to all cases in which Intrade SAS deems the Customer unsuitable (purely by way of example in the case of previous violations of the Contract Conditions for the purchase on the Site or for any other reason deemed legitimate by the company Intrade SAS).

 

Intrade SAS also has the faculty and the right to limit the quantities and / or types of products available on its Site, as well as to change the technical characteristics and to make any changes to the products without giving prior notice to the Customers.  

 

Intrade SAS is authorized to choose to sell its products through the Website exclusively to customers who can define themselves as final consumers and / or dealers who are concessionaires of the Modena Gioielli (B2B) brand.  

 

DESCRIPTIONS AND IMAGES OF THE PRODUCTS

 

The company Intrade SAS undertakes to provide customers with images of the products for sale that are as accurate and truthful as possible, however it informs that these images may slightly differ from the objects actually purchased and shipped to the customer (for example in color, shape or in size). 

This difference could be due to technical problems, photographic effects due to lights, reflections, etc.  

 

The Customer also bears in mind that the photos of the products on sale are deliberately enlarged to ensure a better view and evaluation of the products. 

The Customer is also informed that the items on the website are sold as a whole and not to measure, therefore the company Intrade SAS specifies that the weights, measures, carats, color and purity indicated in the technical data sheet can be considered approximate and they may differ slightly from those of the jewel shipped. However, these slight differences are not such as to constitute a modification of the compressive value of the jewels or of its appearance.  

 

Especially for items containing colored precious stones (i.e. sapphire, ruby, emerald) and semi-precious stones (such as aquamarine, etc.), it is specified that the carat weight contained in the technical data sheet is impossible to respect precisely because it is it deals with natural stones that are cut by hand on the size and not on the carat. 

The displayed carats are to be considered as medium weights, impossible to reproduce precisely. 

Also in this case the Intrade SAS specifies that slight differences in carat weight do not constitute a decrease or an increase in the value of the stones. 

In any case, the jewel delivered to the customer will specify exactly the real carat weight of the stones.
